It is commonly assumed that the pre-codified, customary law of war had little true influence on the decisions or behavior of combatants in the western world. Evaluating this assumption concerning the custom (or norm) of the giving of quarter to enemy combatants in the Texas War of Independence of 1835--1836, this paper finds a strong and widely accepted norm on this subject already by the early 19th century, which exerted significant influence on the behavior in and the results and consequences (...) of the war. The following of this custom of war by the Texian Army, on the one hand, and its intentional and preplanned breaking by the Mexican army headed by Santa Anna for the supposed military and psychological benefits that would accrue from it, on the other, such as in the cases of the Alamo and Goliad, led to severe internal and external consequences for the Mexican side in the short and long term that greatly contributed to their failure to achieve their objectives and to the Texian success in achieving theirs. These consequences indicate the importance of the norms of warfare, even in the pre-codification era, and the major potential costs involved in their breaking or disregard by decision makers. In keeping with other recent efforts, Fodor's CONCEPTS focuses on the metaphysics of conceptual content, bracketing such epistemological questions as, "How can we know the contents of our concepts?" Fodor's metaphysical account of concepts, called "informational atomism," stipulates that the contents of a subject's concepts are fixed by the nomological lockings between the subject and the world. After sketching Fodor's "what else?" argument in support of this view, we offer a number of related criticisms. All point to the same conclusion: (...) Assurance of Learning (AoL) is a critical component of AACSB accreditation because students need to demonstrate skills acquired in the programs they enroll in. The purpose of this paper is to describe how a business school developed its ethics assessment program to fulfill the requirement of AoL when seeking AACSB accreditation. Three learning goals were identified based on the literature, assessment rubrics were created based on learning goals, and a Harvard Business Case was used as the assessment tool. The result (...) of the first round of summative assessments showed that almost all students at least met the standard of these three learning goals. To close the loop, an ethics module and a one-hour video were added to a junior-level course. In the second round of summative assessment, we added a marginal level of competency to the rubric. Protection of civilians has become enshrined as a core task for international peacekeeping missions. How to ensure that civilians are safe from violence and human rights abuses is central to developing military doctrine for peacekeeping; how safe civilians are from attack is central to how peacekeeping missions are assessed both by locals and international observers. However, protection of civilians is often seen as something that is done by active peacekeepers on behalf of passive civilians, potentially missing the ways in which (...) peacekeepers’ actions interact with strategies that civilians undertake on their own behalf. Integrating peacekeeper and civilian self-protection strategies is not trivial, either from a practical or a moral standpoint. Drawing on primary research among women in Liberia, as well as case studies of civilian protection elsewhere, this essay examines the ways in which working with civilians on protection—creating ‘hybrid’ systems of protection—inevitably entangles peacekeepers in civilians’ other social, political, and moral concerns, undermining at least a naïve impartiality. To retain their moral stance, peacekeepers ought to focus on using the safety they provide to allow different local actors to interact safely and, ideally, constructively. (shrink)

Abraham’s “leadership by example” provides a template for business leaders to implement a tone at the top based on a balance of tzedek (righteousness) and mishpat (legal judgement). The former expresses the generosity of spirit required of leaders, while the latter expresses the sound judgement in conformity with both ethics and enacted law. We relate the two constructs to several contemporary theories of justice and jurisprudence. We also relate the development of Abrahamic Justice in the Jewish tradition from antiquity through (...) Maimonides in the middle ages. We draw insight from this tradition to answer a contemporary business ethics question: Do corporate managers violate their fiduciary duty to shareholders if they refuse to engage in legal tax avoidance? The study of perception and the role of the senses have recently risen to prominence in philosophy and are now a major area of study and research.
